Many of the measures proposed within this consultation are modernising measures which are intended to support the land-based gambling industry to thrive sustainably. Making this a criminal offence will ensure a level playing field for all operators. However, there are a significant number of operators who are outside of Bacta’s membership and therefore may not operate any age restrictions. Industry’s perspective was mixed, with some responses stating that the limits for cashless payments should mirror the current ones to minimise the risk of delay to implementing the relevant legislation. There were a range of responses to the questions relating to maximum deposit and committed payment limits. In relation to taking a cautious approach, we think that a £100 limit is appropriate considering that our aim is to try and replicate the process by which someone uses cash to play on a machine. This will act as a safeguard in case someone tries to put more than £100 onto the machine. It will also help mitigate against the risk of someone putting a significant sum of money onto a machine in one go.
The consultation asked the following questions on licence fees. We would expect operators to inform the Commission that they are intending to move onto the expanded regime as these changes will have a material impact on an operator’s business. Operators moving onto the new regime would almost certainly result in a material change to the layout of the premises.
In order to ensure local authorities can continue to carry out their licensing and enforcement duties effectively, we are proposing to raise this cap by either 10%, 20% or 30%. This included a number of measures to adjust outdated regulatory restrictions applying to the land-based gambling sector. The policy proposals set out in this government response are intended to modernise the land-based gambling sector and help it to thrive sustainably. Should card account verification (such as chip and PIN or Face ID on mobile payment systems) be required if direct cashless payments are permitted on gaming machines? The authorisation required by the account holder in these systems mitigates against the risk of cashless payments facilitating crime through stolen cards being used on gaming machines. The risk would be that some forms of direct cashless payment (such as contactless) lack account verification and could allow stolen cards to be used on gaming machines. Therefore, the government’s position is to consult on what principles and player protections should be put in place to support any relaxation of the rules around playing gaming machines with a debit card. Permitting cashless in a targeted way, for example allowing debit cards to be used to pay for particular types of gaming machines or machines in certain types of venues, would not provide clarity on the principles and player protections required within a cashless framework. Over this same period, the weighted average weekly income from gaming machines for Landlord & Tenant pubs fell from around £215 to approximately £190, whilst for Managed pubs this fell from around £230 to approximately £180.

As some of the differences between 1968 Act and Small 2005 Act casinos are brought in line, operating and premises licence fees and mandatory licence conditions should be harmonised accordingly. We would like to make the process for taking up the entitlement of additional machines as simple as possible for both operators and licensing authorities. Are UK Casinos Regulated?
Over half of respondents who indicated an intention to move onto the new regime stated they would look to take up the maximum entitlement of 80 gaming machines in at least some of their venues (57%). These respondents also suggested that increasing the availability of gaming machines will not make customers more likely to take breaks, due to the prospect of other customers taking over their machine and claiming their ‘perceived winnings’. This opposition was primarily from industry stakeholders, who argued that the other space requirements and the imposition of a machine to table ratio would ensure a balance between table gaming, machines and non-gambling space. The casino measures section of the consultation received 41 responses from a variety of stakeholders, including gambling operators and trade bodies, local government organisations, campaign groups and academics. We will introduce an age limit of 18 and over for the use of ‘cash-out’ Category D slot-style gaming machines.
This question elicited the most detailed responses in this chapter from a wide variety of respondents. This proposal will help build a picture of the customer’s play and is already standard in betting shops. The Behavioural Insights Team highlighted some research they had undertaken on individuals’ experiences of gambling management tools.
The Commission works alongside local licensing authorities, which are responsible for issuing premises licences for land-based gambling venues. Established under the Gambling Act 2005, the Commission oversees all commercial gambling in Great Britain — from high-street betting shops and land-based casinos to online slots, poker rooms, and sports betting exchanges. You can apply to us for a licence to provide casino games in a premises (non-remote) or online (remote). It requires remote gambling operators selling into the British market, whether based here or abroad, to hold a Commission licence to enable them to transact with British consumers. The legislative changes also introduced changes to gaming machine entitlements for converted casino premises. For casinos which exercise the extended entitlement and other larger converted casino premises, a new mandatory condition in paragraph 4 of Part 5 of Schedule 1 to the 2007 Regulations requires that the floor area of the gambling area is less than 1,500m².
Online casinos licensed by the UK Gambling Commission are required to meet important safety and fairness standards. Operating licences give the operator the permission to offer a specific type of gambling product. Obtaining a gambling license for an offline casino in the UK is impossible without permission to own and operate dedicated gambling premises. The United Kingdom is one of the most developed countries in the gambling industry, where casinos and other forms of gambling are officially permitted. The Gambling Commission does not issue premises licences.
By contrast, the largest estimated increase in annual GGY received from arcade operators was in the region of £10m. Bingo club responses ranged from no impact on GGY to small improvements in GGY, with the largest estimated increase in annual GGY being in the region of £4m. However, responses suggested that increases in GGY would be greater in the arcade sector than in the bingo club sector.
